These Terms and Conditions outline the rules and regulations for the use of the website https://skymaxxshop.com.

The terms "Client", "You" and "Your" refer to the person accessing this website and agreeing to the Company's terms and conditions. The terms "Company", "Ourselves", "We", "Our" and "Us" refer to SKYMAXX SHOPDEAL GROWTH PVT. LTD.

SECTION 1: Direct Seller Application

1. Each field in the Direct Seller Application is mandatory and must be filled correctly by the applicant who wishes to become an Independent Direct Seller of SKYMAXX SHOPDEAL GROWTH PVT. LTD.

There is no signup fee and joining as an Independent Direct Seller is free of cost.

2. By submitting this application, the applicant agrees to follow the Company's policies, Direct Seller Agreement, Code of Ethics, and all applicable laws including the Consumer Protection (Direct Selling) Rules, 2021 issued by the Government of India.

The applicant shall submit the Independent Direct Seller Contract along with the application.

3. This application represents a valid offer under the provisions of the Indian Contract Act, 1872, from the applicant to enter into an Independent Direct Seller Agreement with the Company.

4. The Independent Direct Seller understands that he/she is not an employee of SKYMAXX SHOPDEAL GROWTH PVT. LTD. and there is no employer-employee relationship between the Company and the Direct Seller.

The Direct Seller shall operate as an independent business person with their own free will and consent.

SECTION 2: Independent Direct Seller Terms

1. The Independent Direct Seller understands that SKYMAXX SHOPDEAL GROWTH PVT. LTD. is a Direct Selling Company dealing in quality products. There is no membership fee, joining fee, or renewal fee charged by the Company.

The Independent Direct Seller only purchases products as per requirement and receives a valid tax-paid invoice against every purchase.

2. The Independent Direct Seller confirms that he/she is above 18 years of age and has provided true, correct, and valid information along with supporting documents.

The Direct Seller shall be fully responsible for the authenticity and accuracy of the identification documents submitted to the Company.

3. The Independent Direct Seller authorizes the Company to conduct e-KYC verification of PAN, Aadhaar, identity documents, and bank details submitted by him/her.

The Direct Seller also authorizes the Company to send official communications related to business activities, updates, offers, and important information.

4. The Independent Direct Seller confirms that all details provided in the Online Direct Seller Application Form have been filled correctly and verified by him/her.

The Direct Seller shall be responsible for any incorrect information, errors, or omissions provided during registration.

5. The Independent Direct Seller agrees to conduct business with honesty, integrity, fairness, and transparency in the best interest of the Company, customers, and business network.

The Direct Seller shall expand his/her business only through legal and ethical methods.

6. The Independent Direct Seller shall not participate in any illegal, fraudulent, misleading, or unethical activity that may cause loss, damage, or harm to the Company, customers, or other Direct Sellers.

7. The Independent Direct Seller shall not force any person to purchase products or join the business opportunity.

The Direct Seller shall explain the Company's products, business plan, Return Policy, and other policies in a fair and transparent manner.

8. The Independent Direct Seller shall not represent himself/herself as a Director, Officer, Franchise Owner, Employee, Agent, or authorized representative of the Company unless officially authorized in writing.

The Direct Seller shall not appoint any person as an agent or representative of the Company.

Confidentiality & Business Conduct

9. The Independent Direct Seller shall maintain confidentiality of the Company's business plans, strategies, customer information, marketing materials, and other confidential information.

The Direct Seller shall not share confidential information with any competitor or unauthorized person.

The Direct Seller shall not make false, exaggerated, or misleading claims regarding product quality, price, ranking, income opportunity, or business benefits.

10. The Independent Direct Seller shall maintain complete secrecy of his/her Online Control Panel, login credentials, password, and other account information.

The Direct Seller shall not share login details with any third party, company, or unauthorized individual.

11. The Independent Direct Seller shall not use the Company's name, brand name, logo, trademark, website, promotional material, or identity for unauthorized advertising or promotional activities.

The Direct Seller shall not create any impression that the Company provides employment, salary-based jobs, accommodation facilities, or guaranteed income opportunities.

Any unauthorized use of Company property may result in suspension or termination of the Direct Seller account.

12. The Independent Direct Seller shall make purchases using his/her own funds and shall not take unauthorized loans from any person, bank, or financial institution for business participation.

The Direct Seller shall not encourage or force any other person to take loans for purchasing products or joining the business.

Payments, Purchases & Customer Transactions

13. The Independent Direct Seller shall not conduct unauthorized cash transactions with third parties on behalf of the Company.

All products sold to customers must be supported with proper invoices issued according to Company procedures.

14. The Direct Seller business rights and associated benefits are non-transferable unless specifically approved by the Company in writing.

Transfer of Direct Seller rights shall be governed by the Company's applicable policies and procedures.

Company Policies & Compliance

The Independent Direct Seller agrees to follow all rules, guidelines, policies, procedures, and instructions issued by SKYMAXX SHOPDEAL GROWTH PVT. LTD. from time to time.

The Company reserves the right to modify, update, amend, or introduce new policies whenever required to maintain transparency, legal compliance, and smooth business operations.

Every Direct Seller shall ensure that their business activities are conducted in accordance with applicable laws, government regulations, and ethical business practices.

Intellectual Property Rights

All trademarks, logos, brand names, website content, product information, designs, images, marketing materials, and other intellectual property belonging to SKYMAXX SHOPDEAL GROWTH PVT. LTD. shall remain the exclusive property of the Company.

No Direct Seller or any third party shall copy, modify, reproduce, use, or distribute any Company property without prior written permission from the Company.

Independent Business Relationship

The Direct Seller acknowledges that he/she is an independent business person and not an employee, partner, agent, franchise holder, or legal representative of SKYMAXX SHOPDEAL GROWTH PVT. LTD.

The Direct Seller shall be responsible for managing his/her own business activities, expenses, taxes, and legal obligations as applicable.

Suspension & Termination

The Company reserves the right to suspend, deactivate, or terminate a Direct Seller account if the Direct Seller violates Company policies, Direct Seller Agreement, Code of Ethics, or applicable laws.

The Company may take action in cases involving fraud, misleading claims, unauthorized activities, misuse of Company information, unethical business practices, or activities harmful to the Company's reputation.

Limitation of Liability

SKYMAXX SHOPDEAL GROWTH PVT. LTD. shall not be responsible for any loss, damage, or business decisions made by Direct Sellers based on personal assumptions, unauthorized promises, or misleading information provided by any individual.

Direct Sellers are advised to follow only official Company communications, policies, and approved business information.

Website Usage

Users accessing the SKYMAXX website agree not to misuse the website, attempt unauthorized access, damage website functionality, upload harmful content, or perform any activity that may affect website security.

The Company reserves the right to restrict access to users who violate website rules or applicable laws.

Governing Law & Jurisdiction

These Terms and Conditions shall be governed and interpreted according to the laws of India.

Any dispute arising out of these Terms and Conditions shall be resolved according to applicable Indian laws and regulations.

The courts having jurisdiction over the registered office location of SKYMAXX SHOPDEAL GROWTH PVT. LTD. shall have authority over legal matters, subject to applicable law.

By accessing the website, registering as a Direct Seller, purchasing products, or participating in SKYMAXX business activities, you confirm that you have read, understood, and agreed to these Terms and Conditions.
